RETURNS

It should be noted that permission to allow return of any materials is at the discretion of Desert Energy Equipment, Inc., and proper return authorization and shipping instructions must be obtained from the Odessa office prior to the physical return of any material.

Only items purchased that are of our manufacture, current design, new and resaleable conditions will be considered for restocking. All material in this category will be subject to a minimum of 15% restocking charge. If any reconditioning or repacking is required, an additional charge will be assessed. All return material should be packaged to avoid damage in transit.

All transportation charges will be at the customer’s expense. If date of purchase or invoice number cannot be furnished, we reserve the right to decide basis credit will be allowed. Any, and all credits issued under this policy will be issued in the form of a merchandise credit memorandum. This credit will be non-negotiable, non-transferable and non-redeemable in cash. Note- any type of debit memoranda for return of material cannot be accepted.

WARRANTY

Desert Energy Equipment, Inc., warrants the products of their manufacture supplied in accordance with this order to be free from defects in material and workmanship under normal use and service. The company’s obligation under this warranty is limited to the repair or replacement of any part or parts of the Company’s manufacture which shall within one year after date of shipment of such product to the purchaser be returned to Desert Energy Equipment, Inc., F.O.B. its shop, Odessa, Texas, and which is determined by the company to have been defective in material or workmanship, provided that the said material or product has been maintained in its original installation and in the continuous possession of the original user. This shall not cover, nor will any allowance be granted by Company for any repairs, alterations, work done or expense incurred in connection with any repairs, alterations or replacements, except that done in accordance with specific written authority from the Company’s home office in Odessa, Texas. This warranty together with the warranty of title and warranty against patent infringement are the sole warranties made by the Company and they are made expressly in lieu of all other warranties expressed or implied by operation of law. COMPANY MAKES NO WARRANTY OF MERCHANTABILITY NOR FITNESS FOR PARTICULAR PURPOSE AND PURCHASER EXPRESSLY WAIVES SUCH WARRANTIES.

The purchaser acknowledges that it has been advised that no agent, employee or representative of the Company has any authority to bind the Company to any affirmation, promise, representation, or warranty concerning any of the product sold hereunder, and unless such affirmation, promise, representation, or warranty is specifically set forth in this agreement, it does not form a basis of this bargain, has not been relied on by the Purchaser and shall not be enforceable against the Company.
